
ALAGBAKA EXTENSION LANDLORDS PETITION JUDICIARY, OTHERS OVER VIOLATION OF COURT ORDER BY UMELU, OLOKUNJUWON FAMILIES
Landlords and Property Owners at Alagbaka Extension in Akure the Ondo State capital have petitioned the Governor of Ondo State, the Chief Registrar of the State High Court over what they described as attempt to violate
an order staying execution in a suit between them and Umelu and Olokunjuwon families.
In a letter signed by Ogaga Erebor, Esq
and addressed to the Chief Registrar of the State High Court, the landlords through their Solicitors, Hillcity Associates set the records straight that the demand from the families that landlords should vacate the lands is totally a contempt of court.
Others who were copied are Governor Lucky Aiyedatiwa whose private residence is located in the community, AIG, Zone 17, Commissioner of Police as well as the state Attorney-General and Commissioner for Justice.
RE: ATTEMPT TO VIOLATE AN ORDER STAYING EXECUTION IN SUIT NO.:

We are counsel to the Applicants -OLUSOLA ALADESUYI,TUNDE OYINLOYE,
OLUSEGUN ADU-PETERS (For themselves and on behalf of owners and Landlords and Residents
Association of Alagbaka GRA Exlension 2,Elekumo Family Land Akure)-in this suit on whose
behalf and instruction we write you.
“It has been brought to our attention that the respondents in the above-mentioned suit,contrary to the
proceedings of the matter,are harassing and threatening to execute certain judgment found in Suit
No:SC/CV/2411/2023 which is a grave departure from and an attempt to circumvent the Order of
Court in SC/CV/1151/2022, granting a stay of execution of the judgment in Suit No:AK/173/2012”.
“To this end, the respondents who are fully aware of all facts in this suit have now contemptuously
erected a poster threatening to eject people from lands in the Alagbaka extension area”.
“It is interesting to note that despite the fact that the Appeal of the defendants (our predecessors in
title)was dismissed,there subsists another Appeal SC/CV/1151/2022 on filed by us against in Suit
No:AK/173/2012,in which an Order staying execution of the judgment on the res of the property
which has long been granted”.
“The said Order staying execution was granted by His Lordship,
Honourable Justice A.0.Adebusoye of the High Court of Ondo State in respect of the pendency of
the Appeal at the Supreme Court”.
“This order for stay of execution dated 17th day of May,2023 still
subsists and will be in effect until the determination of the case at the Supreme Court which is
adjourned to the 27Ih of March 2027”.
“A copy of the ruling is hereby attached.
Accordingly,it is our position that the court should not allow the Respondents to mislead it,as this
may occasion irrecoverable damage to the res in question”.
“We will appreciate if this is brought to the
attention of the Bailiff section to prevent them being misled to carry out execution of an illegal
judgment”.
“It is also worrisome that the harassment did not leave out the number one citizen of the state, His Excellency, Hon. Dr. Lucky Aiyedatiwa as his private residence was defaced”.
